Terms of Service

Welcome to OENARI. Please read these Terms of Service ("Terms") carefully before using the OENARI mobile application (the "App") operated by OENARI ("we", "us", "our").

By creating an account or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you:

  • Are at least 16 years of age
  • Have the legal capacity to enter into these Terms
  • Agree to comply with these Terms and all applicable laws

2. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your password and account
  • You must notify us immediately of any unauthorized use of your account
  • One person may only maintain one account

3. The Service

OENARI is a wine cellar management application that allows you to:

  • Track wines in your personal cellar with detailed storage information
  • Record tasting notes and scores
  • Maintain a wishlist of wines
  • View community statistics and ratings
  • Follow producers and rate vendors

3.1 Free and Paid Features

The App offers both free and paid membership tiers. Features available at each tier are described within the App. We reserve the right to modify features and pricing with reasonable notice.

3.2 Data Accuracy

Wine data in the App (producer information, wine details, EAN codes) is provided for informational purposes. While we strive for accuracy, we do not guarantee that all wine data is complete or error-free.

4. User Content

4.1 Your Content

You retain ownership of content you create, including tasting notes, ratings, reviews, and uploaded photos. By submitting content, you grant OENARI a non-exclusive, worldwide license to display your content within the App for the purpose of providing the service.

4.2 Content Guidelines

You agree not to submit content that:

  • Is false, misleading, or fraudulent
  • Infringes on intellectual property rights of others
  • Contains hate speech, harassment, or threats
  • Contains malware or harmful code
  • Violates any applicable law

4.3 Community Contributions

Certain data you contribute (wine information, EAN codes, producer details) helps build the community database. These contributions may be retained in anonymized form even after account deletion to benefit other users.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's infrastructure
  • Scrape, crawl, or otherwise extract data from the App in an automated manner
  • Create multiple accounts or impersonate others
  • Use the App to promote alcohol consumption to minors

6. Intellectual Property

  • The OENARI name, logo, and App design are our intellectual property
  • The OP (Oenari Points) scoring system is proprietary to OENARI
  • You may not copy, modify, or distribute any part of the App without our written consent

7. Account Deletion

  • You may delete your account at any time through the App (Profile → Delete Account)
  • Upon deletion, all personal data will be permanently removed as described in our Privacy Policy
  • Anonymous community contributions may be retained
  • Account deletion is irreversible

8. Limitation of Liability

To the maximum extent permitted by law:

  • The App is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • We are not liable for data loss resulting from circumstances beyond our reasonable control
  • Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim

9. Modifications

We may modify these Terms at any time. We will notify you of significant changes through the App or via email. Continued use after notification constitutes acceptance of the modified Terms. If you disagree with the changes, you may delete your account.

10. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or harmful activity
  • Remain inactive for an extended period (with prior notice)

11. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Gothenburg, Sweden.
